SmartBuy Club Terms & Conditions

Membership

  1. A company or person who wishes to become a member of SmartBuy can apply in the ways provided by SmartBuy from time to time, and will be bound by these Terms and Conditions, as varied from time to time, upon acceptance by eStore. These Terms and Conditions will apply to all SmartBuy transactions, whether before or after these Terms and Conditions become binding.
  2. eStore may refuse any application for membership.
  3. A member must notify SmartBuy immediately of any change of address. SmartBuy is not liable for a lost SmartBuy Reward Certificate or any unauthorised use of a Certificate.
  4. SmartBuy Reward Certificates will not be valid until these Terms and Conditions have become binding on the intended member. Disputes about any details contained in the SmartBuy Reward Certificates must be notified to eStore within seven days of issue of the certificate. Otherwise the SmartBuy Reward Certificate will be taken to be correct and binding on the member. eStore's decision on any such dispute is final and binding.
  5. eStore may terminate a membership in the SmartBuy program without notice for any reason including, without limitation, if the member or supplementary cardholder:
    - fails to comply with these membership Terms and Conditions
    - abuses any privilege accorded to the member under the SmartBuy program: or
    - supplies any misleading information or make any misrepresentations to eStore, or if the member does not use his or her certificate within six months off issue or dies or becomes bankrupt.
  6. A member may terminate his or her membership in the SmartBuy program at any time by giving written notice to eStore.
  7. SmartBuy Reward Certificates are not transferable, and remain the property of eStore.
  8. Any tax, liability, or duty arising from a member's participation in the SmartBuy program is the responsibility of the member.

Earning and claiming SmartBuy Reward Certificates

  1. SmartBuy Reward Certificates will be issued to the SmartBuy Club Member, and may be used toward the purchase of products or services from eStore by the member.
  2. Certificates may only be redeemed if either the certificate number is quoted at the time of purchase or the certificate is presented/sent to eStore at the time of purchase. The SmartBuy Reward Certificate may not be redeemed against the originating order; it may only be applied to a subsequent order.
  3. At the absolute discretion of eStore, certificates may not be redeemed against some special promotions.
  4. In order to obtain SmartBuy Reward Certificates, a member or supplementary cardholder must notify the participating retailer before the purchase is concluded (or financial services are acquired) that a purchase is a SmartBuy transaction by quoting the customer account number at the time of purchase.
  5. SmartBuy Reward Certificates and the rights they confer cannot be sold, transferred, assigned or otherwise dealt with except in accordance with these Terms and Conditions. SmartBuy Reward Certificates have no cash or monetary value.
  6. Where necessary certificates will be posted or delivered, at eStore's option, to the current address of the member shown in eStore's records. eStore is not liable for any loss, theft or damage to any certificate in the course of post or delivery. If eStore agrees to replace a lost or stolen certificate, the member shall comply with such conditions as eStore imposes.
  7. A SmartBuy Reward Certificate may be only be claimed in full, and may not be claimed in part. If the value of a certificate exceeds the value of the order placed, then the certificate shall be regarded as redeemed, and no credit from this certificate shall be issued to the member.

Other deductions of SmartBuy Reward Certificates

  1. A Reward Certificate relating to a transaction which is cancelled or reversed or where a refund is given shall be cancelled. If the relating Reward Certificate had already been redeemed, then the redeemed value of this certificate shall be deducted from the cancelled, reversed or refunded transaction.
  2. A Reward Certificate relating to a transaction that is not paid within the payment terms of the member may be cancelled to the discretion of eStore.
  3. eStore will deduct from a SmartBuy Reward Certificate's value any credit made in error.
  4. All SmartBuy Reward Certificates that are not redeemed within 6 months of issue of the certificate will expire.

General

  1. The information provided by members will remain confidential, and will not be disclosed to any parties outside of eStore.
  2. Information concerning members including information contained in the application form and information as to transactions resulting in SmartBuy Reward Certificates credits and debits will be held in a database at eStore.
  3. eStore reserves the right to make any changes at any time without prior notice and at eStore's absolute discretion to these Terms and Conditions, the rebate percentage or any other offers to members. eStore will attempt to notify members of any changes but shall not be liable in any way for failure to do so.
  4. SmartBuy reserves the right to suspend or terminate the SmartBuy program at any time without prior notice. eStore will not be liable for the suspension or termination of the SmartBuy program to any member whatsoever including (without limitation) the value of any SmartBuy Reward Certificates issued to a member at the time of suspension or termination.
  5. All conditions and warranties, whether express or implied and whether arising under statute or otherwise, as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the SmartBuy program are expressly excluded to the full extent permitted by law. Any liability eStore may have to a member under statute in respect of such goods and services which cannot be excluded is limited, where permitted, to supplying, or paying the cost of supplying, the goods or services again or repairing, or paying the costs of repairing, the goods, at eStore's option.
  6. Subject to paragraph 4.5 any liability that eStore may have to a member whether for negligence, breach of contract or otherwise is limited:
    - In the case of any claim relating to SmartBuy Reward Certificates, to crediting value of the SmartBuy Reward Certificate to the member.
    - In the case of any claim relating to an award, to crediting the number of SmartBuy Reward Certificates shown in the award schedule as necessary to claim that award to the member's account
    - In any other case to a maximum of $1 for each certificate issued to the member at the time the liability arose.
  7. A notice shall be deemed to be given by eStore to a member if it is sent to the postal or email address of the member appearing in the SmartBuy database.
  8. In these Terms and Conditions "SmartBuy" or "City Software" or "eStore" means City Software Pty. Ltd. (ABN 11054615253) or its authorised representatives.

Amendments to Privacy Act 1988

Please note that there have been amendments to the Privacy Act 1988 ("Act") and these came into effect on 21 December, 2001. These amendments impact on the manner that City Software Pty Ltd collects and manages your personal information, which is defined in the Act, and includes names, addresses etc (information generally contained in your application).

Under National Privacy Principle 1 -Collection, we are required to provide all people forwarding information to eStore with a copy of our Collection Statement. This statement outlines what we collect your personal information for, what we use it for and whom we disclose it to. In addition, it explains your rights and obligations under the Act. If we do not hear from you within 48 hours of receiving this letter, we will assume you have consented to the Collection Statement.

eStore P/L Collection Statement

Personal Information
Personal information is any information or any opinion (whether true or not) about you. It may range from the very sensitive (e.g. medical history or condition) to the everyday (e.g. address and phone number). Personal information includes sensitive information.

Who will be collecting your personal information?
Your personal information will be collected by eStore P/L for its own use and on behalf of other staff members who might require access to your personal information in connection with your Smart Buy Club Application.

How your information will be collected?
Personal information will be collected from you directly when you register your application to eStore P/L or any other information in connection with your application.

How your information will be used?
Your personal information may be used in connection with:

  • your membership account
  • issuing of SmartBuy Certificates
  • future promotions directly relevant to eStore Pty Ltd

Information Corrections or Changes...
You have the ability to correct or change certain information in our records, such as your address and contact information. You may change this information at any time and as often as necessary. With Whom We May Share Information...
We value you as our own customer and we do not share or disclose any information about you to any external company or organisation. The information that you supply to us is used to conduct business transactions with you and to enable us to better meet your needs and requirements. Your information is not sold or given to any other organisation.

Employee Accountability...
Only those eStore employees that have a legitimate business purpose for accessing and handling information obtained by us are given authorisation to do so. The unauthorised access or use of such information by a eStore employee is prohibited and constitutes grounds for disciplinary action.

You can gain access to your information to correct it if it is incorrect. Subject to some exceptions which are set out in the National Privacy Principles (Principle 6 - Access and Correction), you have a right to view and have a copy of personal and sensitive information about you that we hold.
